Part 1

Global Provisions — Applies to All Users

1. About Infodev EDI inc.

Infodev Electronic Designers International inc. ("Infodev EDI", "we", "us", "our") is a Canadian technology company specialising in Automatic Passenger and People Counting hardware, software and services. Our head office is located at 1995 Frank-Carrel Street, Suite 202, Québec City, QC, Canada, G1N 4H9.

Insoft Research Inc. is a wholly owned subsidiary of Infodev EDI. References to "Infodev EDI" in this policy may include Insoft Research where relevant to shared services and infrastructure.

2. Scope of This Policy

This Global Privacy Policy describes how we collect, use, retain, disclose and protect personal information about:

  • Visitors to www.infodev.ca;
  • Clients, prospects, and business partners;
  • Job applicants and candidates;
  • Users of our products and services.

3. Personal Information We Collect

3.1 Website visitors

  • Technical data: IP address, browser type, OS, pages visited, timestamps (via server logs and cookies).
  • Contact data: Name, company, email, phone — submitted via our contact form.

3.2 Clients and business partners

  • Contact and contractual data: Name, title, company, email, phone — for managing the business relationship, contracts, and invoicing.

3.3 Job applicants

  • Application data: CV, cover letter, name, contact information.

4. Purposes for Which We Use Personal Information

  • Website operation: Administer, secure, and improve our website.
  • Client management: Manage contracts, deliver products/services, provide technical support, and issue invoices.
  • Recruitment: Evaluate job applications and manage the hiring process.
  • Marketing communications: Send product updates or newsletters — only with your consent.
  • Security: Detect and prevent unauthorised access to our systems.
  • Legal compliance: Satisfy our legal and regulatory obligations.

5. Sharing of Personal Information

We do not sell, rent, or trade personal information. We may share it with:

  • Insoft Research Inc.: Our subsidiary, under the same privacy obligations.
  • Technology service providers: WordPress/WP Engine (hosting), Google Analytics (analytics), WPForms (forms), Wordfence (security), Complianz (consent). Each is subject to a data processing agreement.
  • Legal or regulatory authorities: Where required by law, court order, or to protect rights and safety.

6. Retention of Personal Information

  • Website contact submissions: 2 years from the date of last contact.
  • Client and contractual data: 7 years from the end of the business relationship.
  • Job applications: 1 year from the date of receipt, unless the candidate is hired.
  • Website analytics: As described in our Cookie Policy (up to 2 years for Google Analytics).

Personal information is securely destroyed or anonymised upon expiry of the applicable retention period.

7. Security

We apply SSL/TLS encryption, access controls, network monitoring, firewall protection, and automatic backups. No electronic transmission is completely secure; we cannot guarantee absolute security.

8. Hosting and Data Location

Personal information is hosted and processed in Canada. For EU/EEA visitors, transfer to Canada is lawful based on the European Commission's adequacy decision.

10. Privacy Officer

Infodev EDI has designated a Privacy Officer. To obtain their name and contact information, or to submit a privacy request, write to privacy@infodev.ca. We respond within 30 calendar days.

11. Changes to This Policy

We may update this policy at any time. The date of the most recent update is shown at the top of this document. Continued use of our website following the posting of changes constitutes acceptance.


Part 2

Canada — PIPEDA

This Part applies to all Canadian residents, in addition to Part 1.

12. Applicable Legislation — Canada

Infodev EDI complies with the Personal Information Protection and Electronic Documents Act (PIPEDA), SC 2000, c 5, which governs the collection, use, and disclosure of personal information in the course of commercial activities.

13. Your Rights Under PIPEDA

  • Right of access: Request access to personal information we hold about you.
  • Right to correction: Request correction of inaccurate or incomplete information.
  • Right to withdraw consent: Withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice.
  • Right to complain: File a complaint with the Office of the Privacy Commissioner of Canada at www.priv.gc.ca.

14. How to Exercise Your Rights — Canada

Submit a written request to privacy@infodev.ca with sufficient information to verify your identity. We respond within 30 calendar days.

LAW 25 — QUÉBEC RESIDENTS ONLY
Act to modernize legislative provisions as regards the protection of personal information
This section applies exclusively to residents of Québec. Law 25 supplements the general Canadian PIPEDA requirements with stronger obligations.
This Part applies exclusively to residents of Québec, in addition to Parts 1 and 2.

15. Applicable Legislation — Québec

In addition to PIPEDA, the Act to modernize legislative provisions as regards the protection of personal information (Law 25), SQ 2021, c 25, applies to Québec residents. Law 25 has been in force progressively since September 22, 2022.

16. Designated Privacy Officer — Law 25

Infodev EDI has formally designated a person responsible for the protection of personal information in accordance with Law 25.

17. Privacy Impact Assessments (Québec)

Before implementing any project involving the collection of personal information that presents a high risk to privacy, Infodev EDI carries out a Privacy Impact Assessment (PIA) in accordance with Law 25.

18. Confidentiality Incidents — Law 25

In the event of a confidentiality incident involving the personal information of Québec residents, Infodev EDI will: assess the risk of serious harm; notify affected individuals where such risk is identified; notify the Commission d'accès à l'information (CAI); and maintain an internal incident register.

Additional Rights Under Law 25 (Québec Residents Only)

  • Right to de-indexation : Request that personal information about you published online be de-indexed or deleted when its collection was not authorized by law.
  • Right to portability : Request your personal information in a structured, machine-readable technological format.
  • Right to automated decision review : Where a decision based solely on automated processing produces significant effects, you have the right to be informed and to request human review.
  • Right to complain to the CAI : File a complaint with the Commission d'accès à l'information (CAI) at www.cai.gouv.qc.ca.

Part 4

United States — State Privacy Laws

This Part applies to residents of the United States, in addition to Part 1.

20. Applicable Legislation — USA

U.S. state privacy laws — primarily the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and equivalent state laws — may apply to our processing of personal information about U.S. residents.

21. Your Rights — USA

  • Right to know: Request disclosure of the categories of personal data we collect about you.
  • Right to delete: Request deletion of personal data, subject to exceptions.
  • Right to correct: Request correction of inaccurate personal information.
  • Right to opt out of sale: We do not sell personal information. No opt-out mechanism is required.
  • Right to non-discrimination: We will not treat you differently for exercising these rights.

Email privacy@infodev.ca with subject line "Privacy Request – [Your State]". We respond within 45 days, extendable by a further 45 days.


Part 5

European Union & EEA — GDPR

This Part applies to residents of the EU and EEA, in addition to Part 1.

23. Applicable Legislation — Europe

For EU/EEA residents, the processing of personal data is governed by Regulation (EU) 2016/679 (GDPR). Infodev EDI acts as data controller for the personal information described in Part 1.

24. Legal Basis for Processing — Europe

  • Consent (Art. 6(1)(a)): Marketing communications and non-essential cookies.
  • Performance of a contract (Art. 6(1)(b)): Product/service delivery, support, and invoicing.
  • Legal obligation (Art. 6(1)(c)): Where required by applicable law.
  • Legitimate interests (Art. 6(1)(f)): Website security, fraud prevention, and analytics.

25. Your Rights Under the GDPR

  • Right of access (Art. 15): Obtain confirmation and a copy of your data.
  • Right to rectification (Art. 16): Request correction of inaccurate data.
  • Right to erasure (Art. 17): Request deletion in certain circumstances.
  • Right to restriction (Art. 18): Request restriction of processing.
  • Right to portability (Art. 20): Receive data in a structured, machine-readable format.
  • Right to object (Art. 21): Object to processing based on legitimate interests.
  • Right to withdraw consent: At any time, without affecting prior lawful processing.

27. International Data Transfers

Data is stored in Canada. Transfers from the EEA to Canada are lawful under the European Commission's adequacy decision. Third-party U.S. processors (e.g., Google Analytics) operate under Standard Contractual Clauses (SCCs).

Rest of the World — General Principles

This Part applies to all users not covered by Parts 2–5, in addition to Part 1.
